A driver memory card (the "Card"), which is issued at a request of a driver, serves to carry records of a working time, i.e. a compliance with the specified driving time, safety breaks and rest periods of individual drivers.
The driver is authorized to possess and use only one card, which is issued in his name, unless it is defective or expired.

05. Who is authorized to act in this case (file an application etc.)

An applicant for the card can be a person who wishes to drive a vehicle fitted with a recording equipment in accordance with the Council Regulation (EC) no. 2135/98 (digital tachograph), he is a holder of a driving license for such a vehicle and has a permanent or temporary (lasting for at least 185 days in a calendar year) residence in the Czech Republic.

06. What are the conditions and procedure for dealing with the living situation

An applicant (driver) is required to properly and truthfully fill out the application for the card.
The card is issued for a valid driving license and the driving license number is indicated on the card.
You can apply for the card along with an application for a driving license. In this case, an application for issuance of the card doesn’t include the number and series of a driving license; this detail shall be added once a driving license is done, which, however, leads to a slight shift in an issuance period of the card.
The card is issued for a maximum period of 5 years. If a validity of a driving license is shorter than that period, the validity of an issued card is limited for the duration of the license.

The application is filed with the local municipality with extended competence (resp. City Hall); locally relevant is a municipal authority with extended jurisdiction (municipality) in the location where the applicant has a permanent (or temporary) residence.

10. What documents are required to have with you

Along with the application must be submitted:

valid driving license,
   
valid proof identity (Identity card or passport, including a valid proof residence)
   
photo 35 mm x 45 mm (up-to-date, meeting the requirements for card photo).
 
The application must be signed personally by the applicant; applicant's signature is one of the indications listed on the card.

11. What forms are required and where are they available

The form „Application for the issuance of a driver memory card" is available at all municipalities with extended competence or on the website of the Ministry of Transport.

12. What are the fees and how they can be paid

The administrative fee for the issuance of a driver memory card is 700 CZK; the fee is payable upon submission.

13. What are the deadlines for processing

If a municipality with extended competence doesn’t detect facts that are inconsistent with the conditions for the issuance of the card, the card will be issued within 15 working days of the request.
For an applicant with a driving license issued by a member state of the European Communities, the Ministry of Transport shall verify that no card has already been issued by another member state of the European Communities, and therefore it prolongs the card issuance period.

15. What other activities are requested from the applicant

The driver is obliged to take the card personally at the local municipality with extended competence.
If the card is damaged or malfunctioning, the driver is obliged within 7 days since he discovered the malfunction or damage to hand it to the appropriate municipality with extended competence and, if necessary, file the application for a replacement card.
A municipality with extended competence will issue a new card within 5 working days of the request.
If the card was lost or stolen, the driver is obliged to apply for a replacement card within 7 days and complement his application with a protocol from the competent authority of the state where the theft occurred (e.g. the local police) or an affidavit in case of loss.
Deadline for submission of application begins on the day when the card holder actually could file a request for the first time (i.e. from the date of return to base or from the time when the loss or theft was discovered).
The card will be issued within 5 working days.
When the driver stopped being a holder of driving license to drive road vehicles fitted with digital tachograph or a driving license to drive such vehicles has been suspended, he is obliged to hand over the card within 5 working days of the decision on withdrawal or suspension of the license or within 5 working days of filing a written notice of waiver of driving license to competent municipality with extended competence.
In case of the application for the card renewal (i.e. a card is expiring), the driver shall, within 15 working days before the expiry date of the card, apply for a new card to a municipality with extended competence locally relevant to the place of his residence (permanent or temporary).
The new card will be issued within 15 working days.

In the event that the card will be made poorly (with any defect), it is necessary to refer the complaint to a municipality with extended competence that issued the card.
This office marks the claimed defect, if necessary. affix documents for the elimination of the defect; also ensures the complaint was handled in the appropriate manner and, on demand, issue a receipt of the card for complaint procedure.
The new card will be issued within 5 working days.

20. What sanctions can be applied in case of a non-compliance

In case of violation of prescribed duties, the driver may be imposed a fine under the law no. 200/1990 Coll., on misdemeanors, as amended, and the law no. 361/2000 Coll., on road traffic and on amendments to certain the laws, as amended.

What to do when the card or recording equipment (digital tachograph) stop working properly while driving?
If the card is damaged or malfunctioning (or has been lost or stolen), at the end of the journey the driver shall print all the information about time periods registered by a recording device. Then he complements this details with data, the card number, eventually his name and driving license number, and confirm his signature.
If the recording equipment is unserviceable or malfunctioning, the driver is obliged to provide on a record sheet or provisional sheet all information about the time periods that were not registered with a recording device or printed out correctly. On the record sheet or interim, the driver writes the card number, sign it and attach it to the card.
How to proceed if it is necessary to renew existing card (based on expiry date)?
It is necessary to seek renewal of the card (see section 15 - last par.).
