04. Basic information about the living situation

On the road and local communication can be connected neighboring property under a permit issued by a road administration authority.
In case of highways, I. class roads and local communications, which are designated as roads for motor vehicles, neighboring property cannot be connected directly to the communication, and to the rest area on these roads can be attached just a building that serves its purpose only to users of this road communication (e.g. petrol station, motel or service station).
Enabling road administration office is also necessary to modify or repeal the current exit.
Authorization for the establishment, modification or cancellation of the exit is a basis for building management led by general building authority.

Substantive jurisdiction to issue a decision is governed by the category and class of road communication on which is to be connected neighboring property.
For highways, a road administration office is the Ministry of Transport, for the I. class roads it is regional office, for II. and III. class roads it is the municipality with extended competence, and for local communications, it is a council.

10. What documents are required to have with you

Submit at the office:

a request for connection of the property on the road,
   
a documentation or situation from which connection parameters are apparent (especially view distances)
   
a statement from the business or another register (attach legal entities)
   
trade certificate or another proof of the trade license (attach natural persons).
 
The issuance of a connection requires the consent of the owner (manager) of the affected road and the consent of the Police of the Czech Republic (if connected to a highway rest area, the consent of the Ministry of Interior).
If the applicant fails to submit a consent to a road administration authority, the authority requests it from the owner of the affected road communication and the Police of the Czech Republic (resp. Ministry of the Interior).

Prescribed forms are not determined.

12. What are the fees and how they can be paid

For permission to connect neighboring property on II. and III. class roads or on a local road communication is collected the administrative fee of 500 CZK.
For permission to connect neighboring property at highway rest area or on I. class road is collected the administrative fee of 1,000 CZK.
The administrative fee can be paid by postal order or cash.

13. What are the deadlines for processing

If it is a simple case, a road administration authority decides without delay; otherwise, it must be decided within 30 days of the application, in particularly complex cases within 60 days of the application.

14. Who are the other participants (concerned) to deal with the living situation

The subject of proceedings for permission to connect the property to a road communication is, in addition to the applicant, also the owner (manager) of the affected road communication, the affected administrative authority is a competent traffic inspectorate of the Police of the Czech Republic (if connected to a highway rest area, it is the Interior Ministry).

Against the decision can be filed a notice of appeal.

Appeals should be submitted to the administrative authority, which issued the decision, within 15 days of receipt of the decision.

20. What sanctions can be applied in case of a non-compliance

Unauthorized establishment, modification or revocation of connecting neighboring property on the highway or local road communication by a natural person is an offense for which may be imposed a fine up to 300,000 CZK.
Unauthorized establishment, modification or revocation of connecting neighboring property on the highway or local road communication by a legal person is an administrative offense for which may be imposed a fine up to 300,000 CZK.
